Abstrak

Penelitian ini mengkaji tantangan hukum ekonomi syariah dalam merespons perkembangan ekonomi digital yang cepat dan kompleks. Kajian ini berangkat dari kesenjangan antara pendekatan maqashid al-syariah yang cenderung normatif dan kebutuhan kebijakan yang lebih operasional dalam menghadapi layanan keuangan digital, aset digital, dan sistem berbasis algoritma. Penelitian terdahulu umumnya masih menempatkan maqashid al-syariah sebagai landasan etik, namun belum mengembangkan pendekatan aplikatif dalam perumusan kebijakan ekonomi digital yang inklusif. Penelitian ini menggunakan metode kualitatif normatif dengan pendekatan ushul fikih dan kebijakan publik melalui analisis literatur klasik, kajian kontemporer, dan dokumen regulasi. Hasil penelitian menunjukkan bahwa pendekatan berbasis maslahah lebih adaptif dan implementatif dalam merumuskan kebijakan hukum ekonomi syariah yang responsif terhadap perkembangan teknologi. Pendekatan ini menekankan keadilan distributif, perluasan akses ekonomi, dan perlindungan konsumen sebagai dasar kebijakan ekonomi digital yang inklusif dan kontekstual.
